Death Penalty Survey Template
A death penalty survey can explore more than a simple yes-or-no position. Use these seven optional questions to distinguish overall opinion, certainty, case-by-case views, important considerations and information needs.
A death penalty survey can explore more than a simple yes-or-no position. Use these seven optional questions to distinguish overall opinion, certainty, case-by-case views, important considerations and information needs.
An overall position does not explain how someone thinks about individual circumstances. Create this questionnaire in SurveyLegend to collect those distinctions respectfully, without graphic examples or assumptions about what a respondent ought to believe.
When to Use This Template
Use this template for adult academic or nonpartisan civic research. Define capital punishment in neutral language and identify the policy context. Do not ask respondents to decide the outcome of a real person's case or provide details of personal victimization.
7 Death Penalty Survey Questions
This voluntary questionnaire asks about capital punishment as a policy. It does not concern a specific case or state what the law currently permits. Every question is optional. You may skip any item or stop. Please do not include names, personal case details or graphic descriptions.

How to Adapt the Questionnaire
Keep the opening definition descriptive and avoid emotionally loaded labels, photos or individual cases. If a named jurisdiction is included, verify any legal context separately and date it. SurveyLegend's guide to leading questions can help review assumptions. Preserve both uncertainty and prefer-not-to-answer options.
When to Ask
Collect responses before a discussion if you want prior views, or afterward if you want views following that discussion; label the timing clearly. Do not combine these as the same measurement. Give participants advance notice of the topic and an uncomplicated way not to participate.
How to Use the Responses
Describe support and certainty separately, then examine whether views depend on circumstances. Treat selected reasons as respondents' explanations, not proof of the policy's effects or of the respondent's character. Report the recruitment method and skipped responses. Review survey bias when interpreting a self-selected discussion group; do not present its percentages as national opinion.
What the Research Adds
Ellsworth and Ross's 1983 survey of 500 Northern California residents distinguished overall attitudes from views about particular circumstances. The abstract notes that respondents sometimes treated policy options as a “scale of strength of belief.” Read the study . This informs the separate questions about overall opinion and case dependence. The historical local study is not evidence of present-day public opinion and does not validate this original questionnaire.
Frequently asked questions
Is this a legal knowledge test?
No. It collects attitudes and information needs. It does not assess knowledge of current law or individual cases.
Can the survey be used with children?
This version is written for adults. It has not been adapted or reviewed for minors.
Does overall support mean support in every case?
Do not assume that. The questionnaire asks separately whether a person's view depends on circumstances.
